■ 더불어민주당은 국익과 법치를 지켜낸 값진 승소를 환영합니다

대한민국 정부가 중국인 투자자가 제기했던 국제투자분쟁(ISDS)에서 최종 승소했습니다. 국제투자분쟁해결센터(ICSID) 취소위원회가 상대 측의 판정 취소신청을 전부 기각함에 따라, 정부는 약 2,641억 원에 달하는 배상 책임을 완전히 벗었을 뿐만 아니라 소송비용과 이자까지 전액 국고로 회수하게 되었습니다. 더불어민주당은 국가 재정을 지키고 사법 주권을 확립한 이번 결실을 진심으로 환영합니다.

이번 판정은 국내 실정법을 위반한 불법 투자는 국제법상 보호 대상이 될 수 없다는 원칙을 재확인했다는 점에서 그 의의가 큽니다. 특히 론스타와 엘리엇 사건에 연이은 이번 성과는 대한민국의 국제법무 역량이 세계적 수준에 이르렀음을 방증합니다. 배상 부담을 털어내고 국민의 소중한 세금을 수호하기 위해 치열한 중재 절차 속에서 헌신적인 노력을 아끼지 않은 법무부 국제법무국과 관계자들의 노고에 경의를 표합니다.

더불어민주당은 우리 정부가 글로벌 통상 및 투자 분쟁에서 주권과 국익을 당당히 수호해 나갈 수 있도록 제도적 뒷받침을 아끼지 않을 것입니다.

■ Democratic Party Welcomes the Valuable Legal Victory That Protected the National Interest and the Rule of Law

The Government of the Republic of Korea has achieved a definitive victory in the Investor-State Dispute Settlement (ISDS) case filed by a Chinese investor. As the ICSID ad hoc Committee dismissed in its entirety the claimant's application for annulment of the arbitral award, the Korean government has not only been entirely relieved of the liability for damages amounting to approximately 264.1 billion won, but will also recover the full legal costs and interest into the national treasury. The Democratic Party wholeheartedly welcomes this achievement, which has protected national finances and upheld our judicial sovereignty.

This decision carries profound significance in that it reaffirmed the fundamental principle that illegal investments violating domestic statutory laws cannot be afforded protection under international law. In particular, coming on the heels of the Lone Star and Elliott cases, this latest milestone attests to the fact that the Republic of Korea's international legal capacity has firmly reached world-class standards. We pay our highest respects to the dedication and tireless efforts of the International Legal Affairs Bureau of the Ministry of Justice and all officials involved, who eliminated the liability for damages entirely and defended the taxpayers' hard-earned money through rigorous and demanding arbitration proceedings.

The Democratic Party will spare no effort in providing institutional support so that our government can continue to resolutely defend national sovereignty and interests in the global arena of trade and investment disputes.
